VOLUNTARY ASSISTED DYING AT PATHWAYS RESIDENCES

UNDERSTANDING THE VOLUNTARY ASSISTED DYING ACT 2022 (NSW)

As of 28 November 2023, the Voluntary Assisted Dying Act 2022 (NSW) (VAD Act) has come into effect in NSW. This legislation allows NSW residents with advanced and progressive life-limiting conditions the choice to end their own life under strict medical supervision.

Eligibility Criteria

To access voluntary assisted dying, an individual must meet certain criteria, including being an adult Australian citizen or resident, having residency in NSW for at least 12 months, and suffering from an advanced and progressive condition causing unbearable suffering.

Our Approach to Voluntary Assisted Dying

In accordance with Section 89 of the VAD Act, Pathways Residences has decided not to provide services related to voluntary assisted dying within its residences. However, we remain committed to fulfilling our statutory obligations under the VAD Act for both permanent and respite residents.

 

Our Responsibilities Under the VAD Act

• Not hindering access to information about voluntary assisted dying
• Engaging with the NSW Voluntary Assisted Dying Care Navigator Service
• Allowing reasonable access for information, assessments, and services
• Coordinating resident transfers to a VAD facility as required

 

Employee Roles and Conscientious Objection

Pathways Residences acknowledges the specific roles, legal rights, and obligations of employees under VAD laws. Some employees may choose conscientious objection, and we support their right to decline involvement while ensuring compliance with statutory obligations.

 

Ongoing Support and Information

We are committed to providing our staff with continuous training and resources to ensure compliance with the VAD Act. Residents seeking more information about voluntary assisted dying are encouraged to speak to their GP, Care Manager, or Executive Manager.
